Business conditions

1. Order and conclusion of the contract

All orders placed in the DYNASPORT SK store, on Ul. M. Mišíka 410/36, 97101 Prievidza or through the online store www.dynasport.sk are binding for both contracting parties. The seller is:

By sending the order, the customer confirms that he has familiarized himself with these purchase and complaint conditions.
The condition for the validity of an electronic order is the true and complete filling in of all data and requirements required by the system during registration or when placing an order.
The purchase contract between the seller and the buyer is created by the purchase of goods in the DYNASPORT store or by sending an online order by the buyer and its acceptance by the seller.
A buyer is a natural or legal person who physically purchases goods in a DYNASPORT store or orders goods or services in the online store www.dynasport.sk and concludes a contract with the seller physically in the store or remotely through means of remote communication such as e.g. e-mail, phone, fax, offer catalog, etc.
If the buyer orders a product or service online via www.dynasport.sk , you place the order by selecting the product via the shopping cart, then entering the delivery method and the payment method and sending the order. After sending the order, you will receive a copy of the order by e-mail with confirmation and data related to its implementation.
On the day the shipment is dispatched, the customer is informed by e-mail or by phone. An invoice will be delivered to the customer together with the original, undamaged goods.

In this text, a consumer (customer) is a natural person who makes a purchase
products or uses services for a purpose other than business, or such a person who is about to make a purchase of these products or services.
Supplier (seller) means a natural person - an entrepreneur or a legal entity with whom the consumer will enter into a contract in the event of a purchase (order) - the so-called "distance contract" - in the case of an online order or a physical contract in the case of a purchase in a brick-and-mortar store.
The store means the DYNASPORT store and also the online store www.dynasport.sk, operated by the supplier and, in the case of the Eshop, represented by a set of websites and e-commerce applications on a certain internet domain.

2. Delivery conditions

The SELLER undertakes:
• sell (in the store) or deliver to the buyer the type and quantity of the ordered goods at the purchase price and under the payment terms that apply on the day the order is sent
• deliver the goods to the buyer suitably packaged so that they are not damaged during transport (in the case of online purchases)

The seller is not responsible for:
• delayed delivery of goods caused by an incorrectly given address of the recipient (in case of online purchase)
• possible non-delivery of goods that occurred due to the fault of the manufacturer (supplier) as a result of any restriction or cancellation of distribution rights or other unforeseeable obstacles

The BUYER undertakes:
• take over the ordered goods, check that the packaging is intact
• pay the price for the goods in full and in accordance with the terms of payment valid on the day the order is sent.

In the event that the buyer does not take over the goods (on the basis of the order), the seller reserves the right to claim compensation for the resulting damage. In the event that the customer does not take delivery of the goods upon first delivery, and requests re-delivery of the goods, he is obliged to pay the costs of the first as well as re-delivery of the goods.
The seller is entitled, depending on the nature of the transaction (quantity, price, transport costs, distance, etc.) above all for a price higher than €250, to ask the buyer to authorize the order in a trustworthy way, e.g. by phone or in writing. In case of refusal of authorization by the buyer, the operator considers the order invalid.

3. Delivery times

Deliveries of the ordered goods are made as soon as possible, depending on the availability of products and the seller's operational capabilities. We usually process orders within 12 to 24 hours. For goods that are not in stock, the goods ordered by you are ordered from the supplier. In this case, the delivery time specified for the specific product applies, or we will notify you in advance by e-mail or by phone about a change in the delivery time of your goods.

4. Prices of goods

The prices listed in our store and online store are valid at the time of ordering the goods. We reserve the right to make printing errors and price changes, in the event of a change in currency rates, in the event of a significant increase in inflation, or in the event of significant changes in terms of delivery from manufacturers and other suppliers of goods.

All prices include 20% value added tax (VAT). The price of the goods does not include postage and packaging.

In the case of an order over EUR 30.00 inclusive, the customer is not charged for postage.

The proof of sale is the invoice, which is attached to each shipment, and which also serves as a delivery note (in the case of online purchases) or a cash register (in the case of purchases in a store).

5. Payments for goods and postage (online purchase)

We send the ordered goods by GLS courier service to the address given by the buyer in the order.
In the case of cash on delivery, the buyer pays the full amount upon collection of the cash on delivery to the delivery person. When paying in advance, the shipment will be dispatched after receiving the payment to our bank account (by cashless transfer or the TrustPay/Trustcard payment gateway).

Postage, including packaging and including insurance, for each individual order is according to the following table:

The listed prices include VAT and are valid for the Slovak Republic.

Delivery by courier has several advantages:

·        delivery within 24 hours of dispatch (delivered on working days)

·        delivery always directly to your hands - home or work

·        in the event of an unsuccessful first delivery attempt, the second delivery attempt is included in the price

Another option is personal collection at the DYNASPORT store, ul. M. Mišíka 410/36, 97101, Prievidza. We do not accept cash on delivery for this option.

6. Order cancellation

ONLINE purchase

The buyer is entitled to cancel the order without giving a reason until the time of dispatch of the goods. Send us the cancellation of the order to our e-mail: info@dynasport.sk , we will immediately send you a confirmation of the cancellation of the order. In case of cancellation of the order, we do not charge any penalties or other fees related to the cancellation of the order. If the canceled order was paid in advance, the price for the goods will be returned to the buyer within 14 days of withdrawal from the contract by bank transfer.
The seller has the right to cancel the order if, due to the sold out of stocks or the unavailability of the goods, even after making all the efforts that can be fairly required of him, he is unable to deliver the goods to the buyer within the period determined by these conditions or at the price indicated in the online store, as long as does not agree with the buyer on replacement performance. The buyer will be informed about the cancellation of the order by phone or in writing, and in case of payment of the purchase price or part of it, the funds will be returned to him within 7 days to the account specified by him, unless otherwise agreed with the seller.

7. Return of goods

Pursuant to § 12 of Act 108/2000 Coll., the consumer may return goods purchased in our online store without giving a reason within 14 working days of receipt at the latest. After receiving the goods, the buyer has the right to unpack and test them in a similar way as when buying in a traditional brick-and-mortar store, to the extent necessary to determine the nature, characteristics and functioning of the goods. The consumer is responsible for any reduction in the value of the goods. Testing does not mean starting to use the product and returning it to the seller after a few days. The provisions in this part expressly do not apply to legal entities and to natural persons-entrepreneurs as well as natural persons-non-entrepreneurs who do not meet the definition in Act no. 108/2000 Coll.

The goods must be returned to the postal address DYNASPORT, Ul. M. Mišíka 410/36 , 97101, Prievidza. Please send the goods in the original packaging, complete, with tags and undamaged.
For a refund, you need to send us:
• goods in original packaging, undamaged
• original invoice, in the case of a purchase in a brick-and-mortar store, a cash register

In the event that the buyer withdraws from the contract and delivers to the seller goods with reduced value that are used, damaged or incomplete, the buyer will reimburse the seller for the costs incurred in connection with the repair of the goods and their restoration to their original condition.
Shipping costs for returning goods are paid by the customer. We do not accept goods returned by cash on delivery method. We recommend that you insure the shipped goods. The price for the goods will be returned to the customer immediately after checking the returned goods, no later than 14 days after withdrawal from the contract, by bank transfer.

All these conditions also apply to purchases in the DYNASPORT brick-and-mortar store.

8. Warranty conditions

The warranty conditions are governed by the provisions of the Civil Code no. 40/1964 Coll. as amended. The warranty period is 24 months. The warranty period is extended by the period during which the buyer could not use the goods due to the warranty repair of the goods. In case of exchange of goods for new goods, the buyer will receive a document on which the exchanged goods will be indicated, and any other claims are applied on the basis of the original delivery note and this claim protocol. In the case of exchanging the goods for a new one, the warranty period for the new goods starts again from the time of receipt. The warranty expires if the goods are damaged by unprofessional use or other non-standard handling.
The warranty period for all persons using the product for the purposes of doing business with this product is not determined by the Civil Code and is determined by the specific importer or manufacturer.
The buyer handles the warranty service at the seller (EMAKO, s.r.o.).

9. Protection of personal data

The data you provide to us after registration or acceptance of the order are stored exclusively on the dynasport.sk server and are not accessible to third parties under any circumstances.

The following personal data are stored in our databases:
In the case of a natural person - a private person: Name, Surname, Address, Telephone, E-mail.
In the case of a legal entity - company: Name of the company, Name of the responsible person, Surname of the responsible person, Address of the registered office of the company, Address of delivery of the goods,
phone, e-mail.

All personal data that you provide to us during registration or when creating an order is used exclusively for the purposes of administrative processing of your order, for the purposes of creating and archiving tax documents and running the dynasport.sk online store. Your personal data is stored in the dynasport.sk databases for an indefinite period.

You can request deletion of personal data from the database or cancellation of registration via e-mail at info@dynasport.sk. This email address is being protected from spambots. Please enable JavaScript to view it.
About data deletion or We will inform you of cancellation of registration via e-mail within 5 working days.
Pursuant to Act no. 428/2002 Coll. from. on the protection of personal data, the operator of the online store dynasport.sk undertakes that the personal data provided by the buyer via the order form will not be provided to a third party without the consent of the owner of this data. At the same time, it undertakes to delete its personal data from its database at the customer's request at any time.
