Withdrawal from the purchase contract

1.1 Withdrawal from the contract by the buyer who is a consumer – right to return the goods
Pursuant to the provisions of Section 7 of the ZoOSnD (Act No. 102/2014 Coll.), the buyer has the right to withdraw from the contract concluded in this way without giving any reason within 14 days from the date of receipt of the goods or from the conclusion of the contract for the provision of services. The withdrawal period is deemed to have been observed if the notice of withdrawal from the contract was sent to the Seller no later than the last day of the period. The consumer may withdraw from the contract, the subject of which is the delivery of goods, even before the withdrawal period has begun. The consumer may use the Seller's withdrawal form -  

FORM FOR WITHDRAWAL FROM THE CONTRACT / EXCHANGE OF GOODS

1.2. The seller is obliged to refund to the consumer, without undue delay and no later than 14 days from the date of receipt of the notice of withdrawal from the contract, all payments received from the consumer under or in connection with the contract, including the costs of transport, delivery and postage and other costs and fees. The seller is not obliged to refund to the consumer payments before the goods are delivered to him or until the consumer has provided evidence of sending the goods back to the seller, unless the seller proposes to collect the goods in person or through a person authorized by him.

1.3. The seller is obliged to refund the consumer's payments in the same way as the consumer used for payment. This does not affect the consumer's right to agree with the seller on another payment method, provided that no additional fees are charged to the consumer in connection with this.

1.4. The Seller is not obliged to reimburse the Consumer for additional costs if the Consumer has expressly chosen a method of delivery other than the cheapest common method of delivery offered by the Seller. Additional costs are understood to be the difference between the costs of delivery chosen by the Consumer and the costs of the cheapest common method of delivery offered by the Seller.

1.5. The consumer is obliged to return the goods or hand them over to the seller or a person authorized by the seller to collect the goods within 14 days from the date of withdrawal from the contract. This does not apply if the seller proposes to collect the goods in person or through a person authorized by him. The period according to the first sentence is considered to have been observed if the goods were handed over for transport no later than the last day of the period.

1.6. When withdrawing from the contract, the consumer only bears the costs of returning the goods to the seller or a person authorized by the seller to receive the goods, in the case of sending by post or courier.

- FREE IN PERSON AT THE STORE: DYNASPORT, M. MIŠÍKA 410/36, 971 01 PRIEVIDZA

- FREE AT THE ZÁSILEKOVňA BRANCH: Submit the packaged goods at the Zásilekovňa branch and dictate the identification number 94831921 to the operator. The operator will take care of everything else.

1.7. The consumer is only liable for any diminished value of the goods resulting from handling of the goods that goes beyond what is necessary to establish the properties and functionality of the goods.

1.8. The buyer - consumer is obliged to return the goods complete, with complete documentation, undamaged, clean, if possible including the original packaging, in the condition and value in which the goods were received, otherwise he is only responsible for the reduction in the value of the goods that arose as a result of such treatment of the goods that goes beyond the treatment necessary to determine the properties and functionality of the goods. The consumer is obliged to return the goods in protective packaging, especially for shoes, please wrap the box in protective packaging so that it does not deteriorate during transport.

1.9. Withdrawal must be effected by the Buyer sending the Seller a notice of withdrawal from the contract within the specified period.

1.10. The buyer can fill out and send
WITHDRAWAL FORM / EXCHANGE OF GOODS
or any other clear statement of withdrawal from the contract, including electronically.

1.11. In accordance with the provisions of Section 7, paragraph 6 of the ZoOSnD, the buyer cannot withdraw from a contract whose subject matter is:
- sale of goods made according to the specific requirements of the consumer, custom-made goods or goods intended specifically for one consumer,
- sale of goods enclosed in protective packaging that is not suitable for return due to health protection or hygiene reasons and whose protective packaging was broken after delivery,
- sale of goods that, after the conclusion of the contract and the receipt of the goods from the seller to the buyer, have been used, washed or used in such a way that its restoration to its original condition by the seller is not possible without increased effort and increased costs.

1.12. The Seller is entitled to withdraw from the purchase contract until the moment of dispatch of the goods, in particular due to the current unavailability of the ordered goods by the Buyer. However, the Seller is obliged to immediately inform the Buyer of the withdrawal at the e-mail address specified by the Buyer in the order. Before withdrawal, the Seller is entitled to offer the Buyer a substitute performance. The Buyer has the right to refuse the substitute performance and withdraw from the purchase contract. In this case, the contracting parties have no claims against each other.

1.13. The provisions of Art. 7 of these GTC expressly do not apply to entities not meeting the definition of a consumer. In the event that the buyer is an entrepreneur, he may withdraw from the purchase contract only:
- for reasons specified in the Commercial Code and other legal regulations,
- special actions of the Seller for returning goods, regardless of whether the buyer is a consumer or a businessman
