Processing of personal data

I. Basic provisions

  • The administrator of personal data according to Art. 4 point 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons in connection with the processing of personal data and on the free movement of such data (hereinafter referred to as "GDPR"), we are, i.e. EMAKO s.r.o. operating the e-shop dynasport.sk and the brick-and-mortar store Dynasport, Ul.   • Personal data is all information about an identified or identifiable natural person. An identifiable natural person is a natural person who can be directly or indirectly identified, in particular by reference to a certain identifier, for example a name, identification number, location data, network identifier or to one or more special elements of physical, physiological, genetic, mental, economic, cultural or social identity of this natural person.

II. What data do we process?

We process the personal data that you provide to us in connection with the use of our services.

  • If you order goods in the e-shop, then we process your invoicing data, contact data (telephone and e-mail) and possibly delivery data required for delivery of goods.
  • If you create a user account, then the data you enter in it (typically billing, contact and delivery data) and the history of your previous orders.
  • If you are interested in sending business announcements and subscribe to them, then your e-mail.
  • If you complain about the goods through our complaint protocol, then the data stated in it.

III. Why do we process data?

Above all, so that we can fulfill what we have committed to. If we could not process the data, then we would inform you. they could not deliver goods from the e-shop, enable user account registration or send business announcements - direct marketing.

The legal reason for processing personal data is:

  • performance of the contract between you and us according to Art. 6 par. 1 letter b) GDPR;
  • our legitimate interest in providing direct marketing (especially for sending business announcements) according to Art. 6 par. 1 letter f) GDPR, which arose on the basis of a conscious relationship between you as a customer and us as an administrator in accordance with reason 47 of the GDPR.

The purpose of personal data processing is, depending on the situation:

  • for the fulfillment of the contract, the processing of your order and the performance of rights and obligations arising from the contractual relationship (when ordering, we require personal data that are necessary for the successful processing of the order - without the provision of data, the contract cannot be concluded);
  • creating a user account to speed up the purchase;
  • faster customer support in case of your questions;
  • sending commercial announcements and related marketing activities (typically analyzing your preferences and displaying corresponding content or displaying advertisements on other websites, so-called remarketing);
  • adapting the quality of our services to your needs (typically performing analyzes to find out how you use the e-shop);
  • the possibility to contact you in case of winning in competitions (in the e-shop or on social networks) for the delivery of the prize.

IV. How do we process data?

We process your data with the utmost care, with an emphasis on their security - just like you, we don't want anything to happen to your data. We protect data in accordance with the GDPR and Act No. 101/2000 Coll. on the protection of personal data and declare that we have taken all appropriate technical and organizational measures to secure data. We also carefully select partners (= data processors) so that they are able to ensure adequate technical and organizational data protection measures.

  • We undertake not to provide your data to any third party with the exceptions listed below in Art. IN.
  • Your data is processed only by trained personnel who protect the data and maintain confidentiality and secrecy.
  • We will process your data for the period necessary to exercise the rights and obligations arising from the contractual relationship and to assert claims from these contractual relationships (for a period of 15 years from the termination of the contractual relationship according to applicable legislation).
  • After the expiration of the relevant periods, we will delete all your personal data.
  • We process information about your previous purchases and visited pages for direct marketing purposes, including profiling, which serves to more accurately and quickly display the corresponding content, i.e. adapting the quality of our services to your needs. You can object to this service at any time free of charge.
  • On our part, there is no automatic individual decision-making within the meaning of Art. 22 GDPR.

V. Who has access to the data?

First of all, we, the data controller EMAKO s.r.o., the operator of the e-shop dynasport.sk and the Dynasport brick-and-mortar store, and our selected employees bound to confidentiality. In addition to us, in some cases, processors also have access to personal data, to whom we transfer the data to a minimum extent for the fulfillment of our obligations - e.g. for an order in the e-shop, we would not be able to deliver the goods without handing over the data to the carrier.

According to your choice, the processors of the necessary data for the order are:

  • payment gateway provider TrustPay/Trustcard in case of online payment
  • carriers: GLS (GLS General Logistics Systems Slovakia SRO)

Data processors for commercial communications are:

  • Mailchimp (The Rocket Science Group, LLC) when ordering, registering and subscribing to commercial messages for sending commercial announcements

Data processors for direct marketing are:

The processors of the necessary data for contract fulfillment and complaints are the individual suppliers of the brands we sell.

Furthermore, we may be obliged to provide your absolutely necessary personal data for the purpose of preventing fraud; in the case of notification of possible criminal acts or threats to public safety. In that case, we will transfer the personal data in question to the competent authority.

VI. What are your rights?

In connection with the processing of personal data, according to the GDPR, you have:

  • the right to access your personal data;
  • the right to correct or supplement personal data;
  • the right to erasure of personal data;
  • the right to data portability;
  • the right to request restriction of processing;
  • the right to object to processing;
  • the right to be informed about a breach of personal data security;
  • the right to file a complaint with the Office for Personal Data Protection;
  • the right to withdraw your consent to data processing at any time;
  • and other rights set forth in the GDPR.

VII. Final provisions

  • We collect your personal data for certain, clear and lawful purposes and do not process it in a way that is incompatible with these purposes.
  • We ensure the processing of personal data so that there are no risks for your rights and freedoms. We implement appropriate technical and organizational measures such as encryption and testing, we ensure continuous confidentiality, integrity, availability and durability of systems and services for processing your personal data.

These terms and conditions take effect on September 1, 2020.
